These Terms and Conditions (“Agreement”) govern the provision of website design, hosting, development and related digital services (“Services”) by Gift of the Gab Web Design (“Service Provider”) to the client (“Client”).
By commissioning, purchasing, approving or continuing to use the Services provided, the Client acknowledges that they have read, understood and agreed to be bound by this Agreement.
Gift of the Gab Web Design will provide website design, development and related services as outlined within the agreed quotation, proposal, package description, mockup approval or written correspondence.
Services are provided either as a Budget Website package or a Bespoke Website project, each with different levels of customisation, revisions and development included.
Budget Website packages are low-cost templated website services built using pre-designed layouts, structures and workflows in order to keep pricing affordable. These packages include standard setup, written content based on Client information supplied, and one round of standard text and image amendments only. Budget Website packages do not include bespoke layout redesigns, repeated restructuring, advanced functionality, unlimited revisions or ongoing development work unless specifically agreed in writing.
Bespoke Website projects are individually designed around the Client’s business requirements and include a more collaborative design and development process with agreed revision stages as outlined within the quotation.
Any additional work, functionality, redesign requests, amendment rounds, consultancy, development time or Services requested outside of the original agreed scope will be subject to separate quotation, negotiation and agreement and may incur additional charges at the current hourly rate.
Budget Websites must be hosted on our servers. This package includes a CMS, one round of standard text and image amendments, and layout as per the chosen example, template or approved mockup preview.
The Budget Website package is designed as a low-cost templated website service. To keep pricing affordable, the overall website structure, layout and design flow are based on pre-designed layouts and are not intended for ongoing redesign or repeated structural amendments.
Clients must provide all required images, business information and instructions for placement on the site.
Included within the package:
• WordPress CMS website
• Written website content based on client information provided
• One round of standard text and image amendments
• Basic SEO-friendly setup
• Google Search Console connection
• Free .co.uk domain and hosting for the first year
Not included within the £295 package:
• Layout redesigns or structural page changes
• Additional amendment rounds beyond the included revision stage
• Major rewrites after approval of written content
• Repeated restructuring based on third-party feedback
• Additional functionality or custom development
• Ongoing updates or training
• Full SEO campaigns
• Website migrations
Additional work outside of the original agreed package scope is charged at £30 per hour.
Hosting renews annually at £120 after the first year. If hosted externally, the client assumes responsibility for all third-party hosting, licensing and associated software costs, including Elementor Pro licensing where required.
Bespoke Websites are fully customisable and individually designed around your business requirements, including SEO optimisation, G4 Analytics setup and scalable functionality as your business grows. Hosting can be provided or sourced independently.
Bespoke website projects include one round of layout and structural amendments following the initial draft, along with reasonable text and image amendments required to finalise the website content.
Minor refinements are included during this stage to allow the website to be adjusted collaboratively before approval. However, significant additional design changes, repeated restructuring, changes in direction after approval, additional functionality requests, or ongoing redevelopment based on third-party feedback may incur further charges depending on the level of additional work required.
Any work falling outside of the original agreed quotation scope will be discussed in advance and charged accordingly.
The Client is responsible for providing all necessary information, materials, images, branding, login details and content required for the provision of Services. All content supplied by the Client must be accurate, lawful, and free from any copyright, trademark, licensing or third-party rights infringements.
Where content is written, restructured or SEO-optimised by Gift of the Gab Web Design based on information supplied by the Client, the Client remains fully responsible for reviewing and approving all final wording, claims, descriptions, qualifications, pricing, policies and business information prior to publication.
The Client is responsible for ensuring that all information displayed on the website is factually correct, legally compliant and suitable for their industry, including but not limited to health claims, qualifications, disclaimers, pricing, service descriptions, regulatory wording and legally required business information.
Gift of the Gab Web Design accepts no legal responsibility or liability for inaccuracies, omissions, misleading statements, regulatory breaches or compliance issues arising from information supplied, approved or requested by the Client or any third party acting on their behalf.
The Client will provide timely feedback and responses to requests and communications. Delays in communication, repeated amendment requests, changes in direction, restructuring requests or ongoing revisions following approval stages may affect project timescales and may incur additional charges.
The Client is responsible for ensuring their website complies with all applicable laws, regulations and industry requirements relevant to their business or profession.
If the Client operates as a sole trader or service-based business without commercial premises, a correspondence or virtual office address may be used where legally appropriate.
Payment terms are outlined within the project proposal, quotation or invoice provided to the Client.
For bespoke website projects, a deposit of 50% of the total quoted project cost is required before work commences. In some circumstances, payment plans may be agreed across four staged payments throughout the project. Any alternative payment arrangement is offered solely at the discretion of Gift of the Gab Web Design.
Budget/template websites priced at £295 are payable in full prior to commencement of services. Any additional work falling outside of the original agreed package scope will be charged separately and invoiced upon completion.
All invoices must be paid by the stated due date. One payment reminder will be issued for overdue invoices. If payment or communication is not received following this reminder, Gift of the Gab Web Design reserves the right to suspend services without further notice.
For hosting clients, suspension may include immediate deactivation of the website, email services and associated hosting features until outstanding balances are cleared in full. A £30 reinstatement fee will apply before suspended hosting services are restored.
For bespoke website projects, all design work, website files, written content and associated intellectual property remain the property of Gift of the Gab Web Design until full payment has been received.
Gift of the Gab Web Design reserves the right to remove, disable or withhold access to any unpaid website, hosting service or digital asset where invoices remain outstanding beyond the payment terms agreed.
Removal, suspension or restriction of access due to non-payment does not remove the Client’s legal responsibility to pay any outstanding balances owed for completed work, agreed services, hosting, licences or project time already undertaken.
Gift of the Gab Web Design reserves the right to pursue recovery of unpaid invoices, including reasonable recovery costs and legal proceedings where necessary.
Gift of the Gab Web Design retains ownership of all pre-existing materials, frameworks, layouts, templates, development systems, written structures, styling, coding methods and design assets used during the creation of the website unless otherwise agreed in writing.
Budget/template websites are provided under licence using the Gift of the Gab Web Design framework and are not sold as fully bespoke intellectual property.
Ownership of bespoke website design work, website files and associated assets does not transfer to the Client until full payment has been received and all outstanding invoices have been cleared.
Upon full payment, the Client receives a non-exclusive, non-transferable licence to use the completed website for their own business purposes.
Gift of the Gab Web Design reserves the right to reuse general design concepts, coding methods, frameworks, layouts and non-client-specific elements across future projects.
The Client may not resell, redistribute, replicate or commercially reproduce any website template, framework or design system created by Gift of the Gab Web Design without prior written permission.
The Client is responsible for obtaining and maintaining all necessary permissions, licences and usage rights for any content supplied for use on the website, including but not limited to images, photographs, logos, graphics, videos, fonts, written content, documents and third-party media.
Gift of the Gab Web Design accepts no liability for copyright infringement, licensing claims, trademark disputes or legal issues arising from materials provided, approved or requested by the Client.
All content supplied, uploaded or created by the Client for use on their website remains the property of the Client. This includes, but is not limited to, blog posts, articles, photographs, images, videos, downloadable documents, testimonials, product information and other business-related content added to the website by the Client.
Where Gift of the Gab Web Design creates written content, blog posts, graphics or other bespoke materials specifically for the Client and payment has been received in full, ownership of that content transfers to the Client unless otherwise agreed in writing.
Nothing within these Terms and Conditions grants Gift of the Gab Web Design any ownership rights over the Client’s business content, branding, intellectual property, products or services. Gift of the Gab Web Design retains ownership only of its underlying templates, frameworks, coding methods, design systems and development processes as set out in Clause 5.1.
Both parties agree to maintain confidentiality of all shared information solely for the purpose of fulfilling obligations under this Agreement. This obligation survives termination of the Agreement.
Both parties also agree to communicate professionally and reasonably throughout the project and following completion of Services. Neither party shall knowingly make false, misleading or defamatory statements which may damage the reputation, business or professional standing of the other.
Where hosting, licensing or website management services are provided by Gift of the Gab Web Design, the website operates within a managed environment maintained using specific software, settings and licensing systems.
The Client may request third-party access where required; however, Gift of the Gab Web Design accepts no responsibility for issues, conflicts, downtime, security problems, loss of functionality, SEO impact or damage resulting from alterations, installations or modifications made by third parties.
Any support, investigation, repair or corrective work required following third-party interference or modification will be chargeable at the current hourly rate.
Gift of the Gab Web Design reserves the right to withdraw technical support for websites that have been substantially modified by third parties outside of the original managed environment.
Gift of the Gab Web Design will provide Services using reasonable skill, care and professional judgement based on industry standards and experience. However, no guarantee can be made that websites, hosting services, third-party software, plugins, integrations, email services or online systems will be completely error-free, uninterrupted, continuously available or immune from technical issues, security vulnerabilities or third-party failures.
Gift of the Gab Web Design shall not be liable for any indirect, incidental, consequential, special or punitive damages arising from the provision of Services, including but not limited to loss of business, loss of revenue, loss of profits, loss of data, reputational damage, search engine ranking fluctuations, third-party software failures, downtime, email disruption or loss of opportunity.
The Client acknowledges that websites, hosting platforms, third-party software, plugins, email systems, domain providers and search engines are subject to external factors outside the control of Gift of the Gab Web Design.
To the fullest extent permitted by law, the total liability of Gift of the Gab Web Design for any claim arising in connection with the Services provided shall not exceed the total amount paid by the Client for the specific Services giving rise to the claim.
Either party may terminate this Agreement in writing where a material breach of these Terms has occurred and has not been reasonably remedied within an appropriate timeframe.
Gift of the Gab Web Design reserves the right to suspend or terminate Services immediately where there is abusive, threatening, unreasonable or inappropriate behaviour, repeated excessive amendment requests outside of the agreed package scope, non-payment, or ongoing project interference which prevents the Services from being delivered reasonably or professionally.
For Budget/Template Website packages, the Client acknowledges that the service is based upon pre-designed layouts, structures and workflows shown within example websites, templates or approved mockups prior to commencement. Purchase of a Budget Website package confirms acceptance of the general design approach, structure and limitations of the service.
Dissatisfaction arising from the templated nature, layout style or pre-agreed structure of the Budget Website package after work has commenced shall not alone constitute grounds for refund or cancellation.
Termination of the Agreement does not remove the Client’s responsibility for payment of all work completed, time incurred, hosting costs, licensing fees or additional Services already provided up to the date of termination.
Budget Website hosting is provided within a managed hosting environment operated by Gift of the Gab Web Design and includes free hosting and a standard .co.uk domain for the first year unless otherwise stated.
Hosting renews annually at £120 per year and covers standard website hosting, server space, email hosting and the Elementor Pro licence required for operation of the website within our managed environment. Hosting and renewal pricing may be subject to change in line with increases to third-party supplier, server, licensing, domain or software costs outside the control of Gift of the Gab Web Design.
Additional third-party premium software, plugins, specialist licences, booking systems, ecommerce extensions or advanced functionality software are not included unless specifically stated within the quotation or proposal and may incur additional ongoing costs payable by the Client.
Maintenance, ongoing website updates, plugin updates, security monitoring, content changes, SEO work, backups, technical support and development work are not included within standard hosting packages unless specifically agreed in writing.
Clients are responsible for renewing hosting services prior to expiry. Failure to renew hosting may result in suspension or deactivation of the website, associated email accounts and connected services.
Gift of the Gab Web Design accepts no responsibility for downtime, data loss, email disruption, third-party software failures, hacking, malware, server outages or issues caused by factors outside of reasonable control, although reasonable efforts will always be made to assist where possible.
Where websites are transferred away from our hosting environment, the Client becomes responsible for all future hosting, licensing, maintenance, software compatibility and associated technical management.
Hosting services provided by Gift of the Gab Web Design include server space, SSL certificates, Elementor Pro licensing, email hosting where applicable, and automatic WordPress core updates within our managed hosting environment.
Hosting and renewal pricing may be subject to change in line with increases to third-party supplier, server, licensing, domain or software costs outside the control of Gift of the Gab Web Design.
Hosting services do NOT include:
• Ongoing website updates, amendments or content changes after launch
• Plugin configuration or third-party software setup
• Training, guidance or “how do I?” support
• Troubleshooting or technical investigations
• Telephone support or calls requesting technical advice or instructions
• SEO campaigns or marketing services
• Repair work caused by third-party interference, client alterations or external software conflicts
• Advanced maintenance, malware removal or recovery work
Any work requested following website launch or outside of the agreed project scope will be charged at the current hourly rate, agreed prior to commencement where possible.
Gift of the Gab Web Design accepts no responsibility for downtime, email disruption, data loss, plugin conflicts, third-party software failures, hacking, malware, hosting outages or issues caused by factors outside of reasonable control, although reasonable efforts will always be made to assist where appropriate.
Clients will normally receive a hosting renewal reminder approximately one month prior to renewal where possible. Hosting cancellation requests must be made in writing no later than 14 days prior to the renewal date. Failure to cancel within this period will result in the renewal fees becoming due.
Failure to pay hosting, renewal or invoice balances by the stated due date may result in suspension of hosting services without further notice. Suspension may include deactivation of the website, email accounts and associated online services.
A £30 reinstatement fee will apply to reconnect suspended hosting services once all outstanding balances have been paid in full.
Gift of the Gab Web Design accepts no responsibility for loss of business, email disruption, downtime, loss of enquiries or data issues resulting from suspension due to non-payment.
Where email hosting is included within a hosting package, Gift of the Gab Web Design will provide the creation of standard mailbox accounts within the 20i hosting environment along with the relevant IMAP/SMTP mailbox settings required for connection.
Gift of the Gab Web Design does not provide IT support services, managed IT services or device support. Our Services relate to website design, hosting and associated web services only.
Clients are responsible for configuring and managing any third-party email software, devices or applications including but not limited to Outlook, Apple Mail, Gmail, mobile phones, tablets, laptops and external email clients once mailbox settings have been supplied.
Gift of the Gab Web Design does not provide ongoing support, troubleshooting, repairs, diagnostics or training for external email applications, syncing issues, software conflicts, password issues, device-specific problems, storage limitations, spam filtering, security settings or software updates affecting third-party email systems.
Where additional assistance is required beyond mailbox creation and supply of connection settings, Clients may need to engage an independent IT support specialist.
Gift of the Gab Web Design accepts no responsibility for issues relating to third-party email software, external IT systems, device configurations or failures outside of the hosting environment provided.
Any assistance provided outside of the original hosting setup is entirely at the discretion of Gift of the Gab Web Design, subject to availability, and may be chargeable at the current hourly rate.
Budget Website packages include basic SEO-friendly setup only. This includes fundamental on-page setup such as page structure, headings, metadata configuration, mobile responsiveness, indexing setup and connection to Google Search Console where applicable.
Bespoke Website packages may include more advanced on-page optimisation depending on the agreed quotation and scope of work.
Gift of the Gab Web Design does not guarantee first-page Google rankings, specific ranking positions, enquiry levels, traffic volumes or business performance as search engine rankings are influenced by many factors outside of our control.
Clients acknowledge that SEO and Google rankings are long-term processes and results are not immediate. New websites can take several weeks or months to be fully indexed, trusted and positioned within Google search results. In competitive industries or locations, meaningful ranking improvements may take 6–12 months or longer depending on competition, domain age, content quality, backlinks, online presence and ongoing marketing activity.
Google rankings are comparative and competitive by nature. Websites are ranked against other businesses targeting similar services, locations and keywords. Generic or highly competitive search terms such as “builder”, “beautician” or “therapist” are significantly harder to rank for than more targeted location-based or service-specific searches.
For this reason, websites targeting smaller service areas, niche services or detailed location pages may often perform better in local search results than websites attempting to rank for broad national or highly competitive terms.
Search engine visibility may also be affected by factors including but not limited to:
• Competition within the Client’s industry or location
• Age and authority of the website domain
• Client reviews and external reputation signals
• Ongoing content creation and website updates
• Social media and marketing activity
• Google Business Profile optimisation
• Backlinks and third-party references
• Technical issues outside our control
• Changes to Google algorithms and ranking systems
Unless specifically included within an ongoing SEO agreement, Gift of the Gab Web Design does not provide ongoing SEO campaigns, content marketing, backlink building, advertising management or traffic generation services following website launch.
Clients remain responsible for ongoing marketing, visibility, social media activity, reputation management and traffic generation once the website has launched.
Budget Website packages are built using pre-designed layouts, structures and workflows in order to keep the service affordable. Layout redesigns, structural amendments, repositioning of sections, page flow changes or bespoke layout revisions are not included within the standard Budget Website package unless specifically agreed in writing.
Budget Website packages include one round of standard text and image amendments only.
Any additional structural amendments, redesign requests, repeated revisions, additional amendment rounds or bespoke development work requested after the initial draft stage may incur additional charges at the current hourly rate.
Bespoke Website packages include one round of layout and structural amendments following the initial draft as part of the agreed design process. Further significant changes, repeated redesigns or changes in direction after approval stages may incur additional charges.
Websites are provided with CMS access to allow Clients to make their own standard text and image amendments following launch where applicable.
Written guidance may be provided for basic text and image editing only. Gift of the Gab Web Design does not provide training, tutorials or ongoing support for advanced website editing, page building, layout design, structural amendments, plugin configuration, additional page creation or Elementor functionality.
Clients wishing to learn advanced editing or development techniques should refer to the official WordPress and Elementor documentation, support centres, FAQs and publicly available tutorial resources such as YouTube.
Gift of the Gab Web Design provides professional web design services and is not a training or education provider. Due to the constantly evolving nature of WordPress, plugins, hosting environments and third-party software, it is not possible to provide ongoing teaching or support covering all future platform changes and functionality updates.
Any repairs, troubleshooting or corrective work required following Client edits, accidental damage, deleted content, layout alterations, plugin conflicts or incorrect modifications will be chargeable at the current hourly rate.
Gift of the Gab Web Design accepts no responsibility for issues caused by Client modifications made after website launch.
Initial consultations may take place by telephone or email where appropriate. Unless otherwise agreed in writing, ongoing project communication, amendment requests, approvals and support queries must be conducted via email in order to maintain accurate project records and workflow management.
Gift of the Gab Web Design operates primarily as an online business model. This structure allows services and website packages to be offered at significantly lower costs than traditional agency pricing.
To keep pricing affordable, packages do not include unlimited consultations, lengthy ongoing telephone discussions, extended advisory services, business coaching or unrestricted email support unless specifically included within the agreed package or quotation.
Reasonable project communication directly relating to the agreed Services is of course welcomed; however, ongoing support, repeated advice requests, extensive guidance, prolonged feedback discussions or consultancy-style communication beyond the original project scope may incur additional charges at the current hourly rate.
Any advice, guidance or support provided outside of the agreed scope of Services is offered entirely at the discretion of Gift of the Gab Web Design.
These Terms and Conditions and any Agreement between the Client and Gift of the Gab Web Design shall be governed by and interpreted in accordance with the laws of England and Wales.
Any disputes, claims or legal proceedings arising from the provision of Services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Clients must provide images and instructions for placement on the site. SEO-friendly setup linked to Google Search Console is included; full SEO services can be added for an additional fee.
Bespoke Websites are fully customisable, including SEO optimisation and G4 Analytics, and scalable as your business grows. Hosting can be provided or sourced independently.
Additional features and layout adjustments are available beyond the first draft; these may incur further charges based on the feedback form submitted.
The Client will provide all necessary information, materials, and content required for the provision of Services. All content provided must be accurate, legal, and free of third-party rights infringements.
The Client will provide timely feedback and responses to the Service Provider’s requests and communications.
All website content, including business information required by law, is the responsibility of the client. Gift of the Gab Web Design is not legally liable for the accuracy or completeness of information supplied by the client.
The client is responsible for ensuring their website complies with all applicable regulations. If the client operates as a sole trader or service-based business without commercial premises, a correspondence or virtual office address may be used.
Payment terms are outlined in the project proposal and quotation.
A deposit may be required before work commences, with the remaining balance payable according to the agreed payment schedule.
Late payments may incur fees or interest charges. Unpaid hosting renewal fees may lead to suspension, with a £30 fee for reinstatement.
Gift of the Gab Web Design retains ownership of any pre-existing materials, templates, or frameworks. Upon full payment, the Client receives a non-exclusive, non-transferable licence for the final website design.
The Client is responsible for permissions and licences for any content provided.
Both parties agree to maintain confidentiality of all shared information solely for fulfilling obligations under this Agreement. This confidentiality obligation survives termination.
We do not permit access to our websites or hosting services to other companies or third parties without prior written consent.
Unauthorised access may result in suspension without liability.
The Service Provider will use reasonable skill and care in providing Services but cannot guarantee the website will be error-free or uninterrupted.
Gift of the Gab Web Design is not liable for indirect, incidental, consequential, or punitive damages arising from Services.
Either party may terminate this Agreement with written notice if the other breaches a material provision and fails to remedy it. Termination does not release the Client from payment for all work completed.
Budget Website hosting is provided on our servers with a free first year. Renewal is £120 per annum.
Maintenance is not included with any hosting package.
Hosting includes server space, SSL certificates, email hosting (where applicable), and automatic WordPress core updates.
Hosting does NOT include:
Any work requested after launch is billed at £30 per hour, agreed prior to commencement.
Clients receive a renewal notice one month prior. Hosting may be cancelled within two weeks; otherwise, fees are due.
Failure to pay results in suspension and a £30 reconnection fee.
Custom email setup is provided. We do not support external setups beyond a 20i mailbox.
Budget Websites include SEO-friendly setup only. Bespoke websites include full optimisation.
Clients are responsible for marketing and traffic generation after launch.
Budget Websites include one round of amendments. Further changes or bespoke layout revisions may incur fees.
A CMS is provided for self-editing. Incorrect edits requiring repair are billable at £30 per hour.
Initial consultations may occur by phone. All ongoing communication must be via email unless otherwise agreed.
This Agreement is governed by the laws of England and Wales. Disputes fall under the jurisdiction of its courts.
